ElevateMD: The Practice Growth Systemâą
The Business Club Inc.
Effective Date: The date the Client accepts these Terms and Conditions and submits payment.
By purchasing enrollment in ElevateMD: The Practice Growth Systemâą (the âProgramâ) from The Business Club Inc. (âTBCIâ), you (âClientâ) agree to the following Terms and Conditions in full. Submission of payment constitutes legal acceptance.
1. Program Description
ElevateMD is a fully managed, full-service marketing, public relations, and advertising system built exclusively for private medical practices. It includes strategic planning, creative production, technical execution, platform integration, and performance reporting delivered on a monthly basis.
The Program is ideal for physicians seeking to attract, retain, and grow a qualified patient base while enhancing authority, reputation, and visibility across multiple channels.
2. Monthly Fee and Payment Terms

The monthly program fee is $10,000 USD

Payment is due in full before the start of each 30-day service cycle
-
No services will be provided until payment has been received
-
Monthly payments are non-refundable once any work has commenced within that billing cycle
3. Cancellation Policy

The Program requires a minimum of 60 calendar daysâ written notice for cancellation
-
Client remains responsible for full payment of the final two months of services following notice
-
Cancellations will take effect after the 60-day period concludes
-
There are no partial-month or prorated refunds; billing remains monthly and full regardless of cancellation timing
This cancellation policy ensures sufficient time for active project closure, asset transition, reporting delivery, and media conclusion.
4. Services Included
The ElevateMD Program is a comprehensive growth engine and includes, but is not limited to:

Local keyword strategy, review management, listing updates, category targeting, and photos

Mobile-optimized design, patient-conversion copy, Rank Math Pro integration, keyword implementation

Campaign creation, ad copy, creative production, and ad management across selected platforms

Media outreach, press release development, article placement, brand authority positioning

Logo refresh, branded office materials, brochures, video production, waiting room visuals

Physician Office Incentive Programs
Staff reward programs, cruise giveaways, referral-based incentives for retention and satisfaction

Social Media Management
Post creation, page management, community engagement, and brand-aligned content publishing on Facebook, Instagram, TikTok, and LinkedIn

Commercial Production + Media Placement
Scriptwriting, video/audio production, broadcast-ready formatting, and coordination with local/regional networks

Quarterly Reports + ROI Dashboards
Performance tracking, lead source analysis, campaign effectiveness, and strategic adjustments

Dedicated Marketing Department
Your assigned team handles execution, communication, planning, creative, compliance, and reportingâserving as your outsourced in-house department
5. Client Responsibilities
The Client agrees to:

Provide timely access to all necessary platforms, logins, or documentation
-
Participate in onboarding calls and strategy sessions
-
Respond to feedback requests, content approvals, and information requests within a reasonable timeframe
-
Disclose any legal, compliance, or advertising limitations relevant to their specialty or location
Failure to provide required materials or responses may delay services but does not suspend billing.
6. Performance Disclaimer
The Business Club Inc. provides expert-level services designed to improve visibility, authority, and patient acquisition. However, we do not guarantee specific outcomes, including but not limited to:

Increases in patient volume

Revenue growth
-
Specific rankings, impressions, clicks, or conversions
-
Press or media placements
-
Lead quality, closing rates, or ROI
Business performance depends on multiple external factors such as competition, market demand, pricing, internal operations, and patient experience.
7. Third-Party Tools & Vendor Accounts
TBCI may utilize or establish third-party accounts, platforms, or software to complete services (e.g., hosting, Rank Math Pro, Google Ads, Meta, Zapier, CRM tools). If the Client does not already have access, we may set up accounts in the Clientâs name and provide full ownership access after onboarding.

The Client is solely responsible for all renewal fees, third-party compliance, and subscription continuity once accounts are handed over

TBCI is not responsible for changes, outages, price adjustments, or platform policy shifts imposed by external vendors
8. Revisions & Project Scope
All packages include reasonable revisions, content edits, and ad adjustments within scope.
Requests that substantially alter the original plan or exceed included scope may require a change order and additional fees.
Examples of out-of-scope work include:

Entire website redesigns mid-program

Additional video or print campaigns beyond original service mix

Emergency rush requests
-
Legal reviews, HIPAA consulting, or compliance certification
9. Ownership & Intellectual Property
Upon full payment, the Client owns the final versions of:
All unused designs, templates, or frameworks remain the intellectual property of The Business Club Inc.
TBCI may showcase finished work in its portfolio unless otherwise requested in writing.
10. Limitation of Liability
The Business Club Inc. shall not be liable for:

Regulatory violations due to inaccurate or unverified client-provided claims

Losses due to denied ad campaigns, policy enforcement, or patient behavior
-
Third-party technical errors or platform outages
-
Business income loss, opportunity cost, or consequential damages
Maximum liability under this agreement is limited to the amount paid by the Client during the most recent 30-day period.
11. Indemnification
The Client agrees to indemnify and hold harmless The Business Club Inc. from any claims, legal actions, or damages arising from:

False or misleading claims in content provided by the Client

Improper use of advertising platforms or healthcare-related compliance breaches
-
Use of assets outside their approved and intended purpose
12. Confidentiality
All client information, login credentials, marketing strategies, and proprietary materials shared during the relationship shall remain confidential. TBCI will not share or disclose this information except as required to complete services or by law.
13. Governing Law
These Terms shall be governed by and interpreted under the laws of the Commonwealth of Virginia.
All disputes shall be handled in the courts of Chesapeake, Virginia.
By submitting payment, the Client confirms that they have read, understood, and agreed to these Terms and Conditions in full.
