First-Level Marketing Package™
TBC Inc.
Effective Date: The date payment is submitted and these Terms and Conditions are accepted in full.

By submitting payment for the First-Level Marketing Package™ from TBC Inc. (“TBC Inc.”), the purchaser (“Client”) agrees to the following Terms and Conditions. Submission of payment constitutes binding acceptance of these terms in full.

1. Program Overview

The First-Level Marketing Package™ is a monthly service agreement providing foundational marketing support for visibility, brand positioning, lead generation, and business growth. Services are offered on a recurring monthly basis and are customized to the needs of each Client based on an initial audit.

2. Program Components

The Client will receive the following services during each paid month of service:

• Website & SEO Optimization
  Includes basic SEO structure, speed optimization, keyword integration, and RankMath Pro configuration (WordPress only).

• Google Business Profile Optimization + Review Strategy
  We optimize your listing, implement reputation-building tactics, and initiate systems to help you generate reviews.

• Business + Marketing Audit
  We evaluate your business and marketing systems to identify areas for growth, clarity, and consistency.

• Daily Social Media Posting (Facebook, TikTok, LinkedIn)
  We provide one post per day per platform using brand-aligned, growth-driven content.

• Branded Brochure Design + Graphics Kit
  Includes one brochure and a bundle of promotional graphics for use online and in print.

• Customer & Staff Feedback Strategy
  Anonymous surveys and feedback prompts to gather insights on experience and service quality.

• Foundational SEO + Keyword Strategy
  Includes keyword selection and implementation across website, content, and metadata.

• Optional Billboard Coordination
  TBC Inc. can assist with local billboard coordination. Ad costs are not included.

• Monthly Reporting
  Client will receive a summary of performance, insights, and updates each month.

Note: TBC Inc. may update or improve included services for quality, strategy, or market alignment at its sole discretion.

3. Payment Terms

• Full payment is due in advance of services being rendered each month.

• Services are not performed without successful receipt of payment.

• Program operates on a month-to-month basis unless a longer term is separately agreed in writing.

• All payments are final and non-refundable once services begin for the paid month.

4. Cancellation Policy

• A minimum of sixty (60) days’ written notice is required to cancel participation in the program.

• Cancellations are processed only at the end of the month in which notice is received.

• The 60-day notice period begins on the first day of the following month, resulting in two full billing cycles' notice before termination.

• Mid-month cancellations will take effect at the end of the second full month following the notice period.

• No partial month refunds will be issued.

5. Client Responsibilities

The Client agrees to:

• Provide all requested business access credentials, content, and approval in a timely manner

• Participate in audit and review sessions

• Approve or respond to design and strategy materials within 3 business days when requested

• Maintain open communication to ensure accurate representation of the brand and timely delivery of services

Failure to cooperate or provide requested information may impact outcomes. TBC Inc. is not responsible for delays or limited results caused by missed approvals, poor communication, or incomplete client participation.

6. Implementation Disclaimer

TBC Inc. guarantees delivery of agreed services but does not guarantee specific business outcomes, including revenue, leads, or growth, as these are dependent on multiple factors outside of TBC Inc.'s control, including but not limited to:

• Client responsiveness

• Industry demand

• Sales team effectiveness

• Local competition

• Economic conditions

7. Intellectual Property

All custom content, templates, designs, and strategies developed remain the intellectual property of TBC Inc. unless otherwise agreed in writing. The Client is granted a license for internal use only.
Templates, content, and systems may not be resold, copied, distributed, or shared externally without written permission from TBC Inc.

8. Confidentiality

TBC Inc. agrees to maintain strict confidentiality over all Client business data, login credentials, marketing strategies, and insights.
The Client agrees not to share or reuse TBC Inc.’s proprietary materials outside of the intended scope of this agreement.

9. Indemnification

The Client agrees to indemnify and hold harmless TBC Inc. from any claims, liabilities, losses, or damages arising from:

• Misuse or modification of delivered materials

• Business decisions made independently by the Client

• Delays caused by Client or third-party vendors

• Inaccurate or incomplete information provided by the Client

10. Limitation of Liability

TBC Inc. shall not be liable for:

• Lost profits or indirect damages resulting from implementation of marketing strategies

• Platform downtime (e.g., Facebook, Google)

• Results affected by Client non-compliance or refusal to follow strategy

• Any liabilities exceeding the monthly amount paid for services

Total liability is limited to the monthly amount paid by the Client for the specific month in question.

11. Governing Law

These Terms & Conditions shall be governed by the laws of the Commonwealth of Virginia.
Any disputes shall be resolved exclusively in the appropriate courts located in Chesapeake, Virginia.

12. Agreement Acknowledgment

By submitting payment, the Client confirms full acceptance of these Terms and Conditions and waives any claim of non-agreement, miscommunication, or misrepresentation. These terms remain binding throughout the duration of the agreement.
